Trial, Payment and Refund Policy

Trial & card on file. All trials require a valid credit card on file. The trial period is 3 days. If you do not cancel your trial prior to its expiration, your card will be charged the selected plan amount (monthly or annual) and your subscription will begin.

Admin / Setup fee included. The admin fee is built into the total subscription price ($397 portion for the monthly plan; $697 portion for the annual plan).

Cancellation & short-window refund policy. If you cancel within 48 hours after the initial charge, you may be eligible for a refund of the total amount. XALIO reserves the right to retain the setup & admin portion ($397 monthly / $697 annual) when calculating refunds for cancellations occurring after 48 hours of the initial charge. After 5 days (including weekends) from the initial charge, subscription billing and fees are non-refundable except where required by law.

How to cancel. To avoid being charged, cancel via your account page or by contacting support at support@xalio.org before your trial ends. Cancellation after the initial charge must be requested in writing; refunds (if eligible) will be processed within 7 business days.
XALIO — Terms & Conditions
Effective Date: December 22, 2025
These Terms & Conditions (“Terms”) govern your use of XALIO’s AI receptionist services (the “Service”), provided by XALIO, Inc. (“XALIO,” “we,” “us,” or “our”). By signing up for a trial or paid subscription, using the Service, or otherwise accessing XALIO’s platform, you agree to be bound by these Terms.
If you do not agree to these Terms, do not sign up for or use the Service.
1. Services Provided
XALIO provides an AI-powered receptionist service that answers inbound calls and texts, captures lead information, qualifies leads, books appointments, and integrates with calendar and CRM systems (collectively, the “Service”). Features, availability, integrations, and functionality may change over time.
2. Eligibility
You represent and warrant that you are at least 18 years old and have full authority to enter into these Terms on behalf of the business or organization you represent. You agree to comply with all applicable local, state, national, and international laws while using the Service.
3. Trial Period; Card on File
We offer a 3-day free trial for new accounts (the “Trial”). A valid credit card is required to start the Trial. No charge is made at the time you start the Trial. If you do not cancel prior to the Trial’s expiration, your selected plan will be charged automatically as described in Section 4.
4. Fees, Billing & Payment Terms
4.1 Plans & Pricing. Current pricing is displayed on our Pricing page. As of the Effective Date, our standard published plans are:
Monthly Plan: $897 per month (includes one-time setup/admin portion built into price; includes 100 AI minutes per month; overage billed at $0.25/minute)
Annual Plan: $8,897 per year (includes one-time setup/admin portion built into price; includes 100 AI minutes per month; overage billed at $0.25/minute)
4.2 Billing. If you do not cancel your Trial before it ends, your card will be charged the full plan price selected ($897 or $8,897) and your subscription will start. Subscriptions automatically renew according to your plan’s billing cycle (monthly or annual) unless cancelled.
4.3 Taxes. All fees are exclusive of taxes, duties, and governmental assessments. You are responsible for any such taxes; if required, we may collect applicable taxes at checkout or billing.
4.4 Overage & Add-On Charges. Additional minutes beyond your included allocation are billed at $0.25 per minute unless otherwise agreed in writing.
4.5 Failed Payments. If a payment fails, we may suspend or terminate your Service until payment is received. You are responsible for any collection costs and late fees where permitted by law.
5. Cancellation & Refund Policy
5.1 Cancellation. You may cancel at any time via your account dashboard or by contacting support@xalio.org
. To avoid the initial charge for the first billing cycle, you must cancel before the Trial ends.
5.2 Refunds — Short Window Policy. If you cancel within 48 hours after the initial charge (the first payment after your Trial), you may be eligible for a refund minus the setup/admin portion embedded in the initial charge. Because plan prices include a one-time setup/admin portion, XALIO reserves the right to retain the following setup/admin amounts when calculating refunds for cancellations within the 48-hour window:
Monthly Plan: $397 setup/admin portion
Annual Plan: $697 setup/admin portion
(Example: If you were charged $897 for the Monthly Plan and cancel within 48 hours, XALIO may retain $397 and refund $500.)
Refunds, if issued, will be processed within 7 business days to the original payment method.
5.3 No Refund After 48 Hours. If cancellation occurs after 48 hours from the initial charge, subscription billing and fees are non-refundable, except as required by law.
5.4 Prorated Refunds. For subscription renewals (monthly or annual), any refunds or prorated credits are at XALIO’s sole discretion and subject to the refund rules above.
5.5 How to Request a Refund. To request a refund or cancellation, contact support@xalio.org
with your account details. Refund requests will be evaluated per this policy.
6. Account Onboarding & Setup
6.1 Onboarding. Following payment and account creation, you will be asked to complete an onboarding form with business details that we use to configure your AI receptionist. Timely completion of onboarding information is your responsibility.
6.2 Setup Work. XALIO performs setup work (routing, script customization, CRM/calendar integrations) as part of the one-time setup/admin portion included in your initial charge. Work performed during the Trial may be non-recoverable, which is why setup/admin amounts are retained consistent with Section 5.
7. Use, Prohibited Conduct & Compliance
7.1 Permitted Use. You may use the Service for lawful business purposes consistent with these Terms and any applicable Acceptable Use Policy posted on our site.
7.2 Prohibited Conduct. You will not (and will not permit others to): use the Service to violate laws or third-party rights; send spam or unsolicited messages; use the Service to facilitate fraud or unlawful activity; interfere with Service operation; access the Service to build a competing product; or attempt to circumvent security or limitations.
7.3 Co-Parenting & Third-Party Communications. If you use the Service in contexts involving third parties (co-parenting, ex-partners, etc.), you are responsible for complying with privacy, consent, and local laws around communications and recording.
8. Data, Privacy & Recording
8.1 Data Collection. XALIO will process call, text, message, and lead data to provide the Service. We may store transcripts, voice data, logs, and other metadata necessary to deliver and improve the Service.
8.2 Consent & Recording. By using the Service, you represent that you have obtained any required consents from call participants for recording or processing calls and messages. You are responsible for complying with all applicable wiretapping, recording, and privacy laws governing calls and texts.
8.3 Privacy Policy. Our Privacy Policy explains how we collect, use, store, and share personal data. By using the Service you agree to the Privacy Policy. (Link to Privacy Policy)
8.4 Customer Data Ownership. You retain ownership of data you submit to the Service (“Customer Data”). XALIO may process Customer Data to provide and improve the Service as described in our Privacy Policy.
9. Intellectual Property
9.1 XALIO IP. XALIO and its licensors retain all rights, title, and interest in and to the Service, software, systems, and associated intellectual property. Nothing in these Terms transfers ownership of XALIO’s IP to you.
9.2 Customer Content. You grant XALIO a non-exclusive, worldwide, royalty-free license to use and process your Customer Data to deliver the Service and for related internal business purposes (including anonymized improvement of models), consistent with the Privacy Policy.
10. Service Levels & Support
10.1 Support. We provide support via support@xalio.org
and via any support channels described in your account. Response times depend on plan level and are subject to availability.
10.2 Service Availability. We strive for high availability but do not guarantee uninterrupted service. We may perform scheduled or emergency maintenance. We are not liable for interruptions due to third-party systems (telecom carriers, internet providers, CRMs).
10.3 Credits. Any service credits for downtime or SLA breaches are at XALIO’s sole discretion and, if provided, will be your sole remedy.
11. Warranties & Disclaimers
11.1 Mutual Warranties. Each party represents it has the power and authority to enter into these Terms.
11.2 Disclaimer. EXCEPT AS EXPRESSLY PROVIDED, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” XALIO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11.3 No Guarantee of Results. While XALIO aims to improve lead capture and bookings, we do not guarantee any particular revenue, client acquisition, or outcome.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, XALIO AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF BUSINESS, OR LOSS OF DATA, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE. XALIO’S AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO XALIO IN THE THREE (3) MONTHS PRIOR TO THE CLAIM (OR $500, IF NO AMOUNT WAS PAID). SOME JURISDICTIONS DO NOT ALLOW LIMITATION OF LIABILITY, SO THIS LIMITATION MAY NOT APPLY TO YOU.
13. Indemnification
You agree to indemnify and hold XALIO, its officers, employees, and agents harmless from any claim, loss, liability, damages, cost, or expense (including reasonable attorneys’ fees) arising from your misuse of the Service, your breach of these Terms, violation of law, or third-party claims related to Customer Data.
14. Termination
14.1 Termination by You. You may cancel your subscription at any time, subject to the refund rules in Section 5.
14.2 Termination by XALIO. We may suspend or terminate your account for violation of these Terms, non-payment, illegal activity, or other legitimate business reasons. Upon termination for cause, you will not receive a refund except as required by law.
14.3 Effect of Termination. Upon termination, access to your account and Customer Data may be disabled. We may delete or archive data consistent with our data retention policy. You are responsible for exporting any data you wish to retain prior to termination.
15. Changes to Service & Terms
XALIO may modify or discontinue the Service (or features) at any time. We may also modify these Terms; material changes will be posted with notice. Continued use after notice constitutes acceptance of the modified Terms.
16. Governing Law & Dispute Resolution
These Terms are governed by the laws of the state in which XALIO is incorporated (or, if different, the jurisdiction specified by XALIO), without regard to conflicts of law principles. Any dispute arising out of these Terms will be resolved in state or federal courts located in XALIO’s jurisdiction, unless otherwise agreed. You and XALIO consent to venue and personal jurisdiction of those courts.
17. Miscellaneous
Entire Agreement. These Terms, together with the Privacy Policy and any order forms, constitute the entire agreement between you and XALIO regarding the Service.
Assignment. You may not assign your rights under these Terms without XALIO’s prior written consent. XALIO may assign its rights.
Severability. If a court finds any provision unenforceable, the remainder of the Terms will remain in effect.
Waiver. Failure to enforce a right is not a waiver of that right.
